Accreditation procedure for Foreign observers

According to art. 73 of Law 33/2007 on the organization of the elections for the European Parliament, republished and with the subsequent modifications, and art. 4 of the Decision of Permanent Electoral Authority (PEA) nr. 9 of 25 March 2019 regarding the procedure of accreditation for the elections for the European Parliament on 26 May 2019, foreign observers for the election of Romanian members to the European Parliament are accredited by the PEA upon proposal from the Romanian Ministry of Foreign Affairs (MFA).

In order to ensure internal-external cohesion and bearing in mind the spirit of the Law no. 33/2007 and of the PEA Decision no. 9/2019, the accreditation procedure for foreign observers is the following:

  • An official request for accreditation, accompanied by the indicated documents, needs to be sent to the Ministry of Foreign Affairs of Romania – Directorate for Human Rights, Protection of Minorities and the Council of Europe, until 9 May 2019, 16:30, EET.
  • Based on these requests, the Ministry of Foreign Affairs of Romania will submit the proposals to provide accreditation for foreign observers to the Permanent Electoral Authority by 10 May 2019, 16.30 EET.
  • The Permanent Electoral Authority will inform directly the person that requested the accreditation on its decision to issue the accreditation for observing the election of the Romanian members of the European Parliament on the 26th of May 2019.

 

The necessary documents for the accreditation of foreign observers are:  

  • Letter of accreditation issued by the international organization/institution governmental or non-governmental, in English or French, sent to the Ministry of Foreign Affairs of Romania – Directorate for Human Rights, Protection of Minorities and the Council of Europe. Letters addressed TO WHOM IT MAY CONCERN are not accepted. The letter of accreditation will mention that its representative is assigned to observe the European Parliament election process on 26 May 2019 and will indicate for further communication the e-mail address of the proposed person to be accredited as observer. The letter will have the official header of the international organization/institution governmental or non-governmental, the signature of the Director/Manager, date of issue and official stamp.
  • Accreditation form filled in (scanned and word format).
  • Copy of the statute of the organization
  • Copy of the Court decision on the foundation of the organization
  • Copy of the organization’s ID;
  • Copy of passport;
  • Photo – passport type – electronic format, named surname_name_international organization_ name;

All documents will be sent by e-mail to acreditare.obs@mae.ro.

All requests, accompanied by the supporting documents, will be sent to the MFA, no later than 9 May 2019, 16:30 (Romanian time). According to the legislation, the deadline by which the MFA is allowed to send proposals for accreditation to the PEA is no later than 15 days before the Election Day.

Accreditations will be issued by the PEA and they will be sent to the applicant according to the option mentioned in the accreditation form either by e-mail or in person.

The copy of the accreditation has the same legal value as the original. The accreditation is valid only if accompanied by an ID document.

In accordance with art. 73 para. (10) and (11) of Law 33/2007:

  • Persons accredited may observe the electoral process during the day of the vote, from 6.00 am until the closing of the voting process and the signing, by the members of the electoral bureau of the voting station, of the minutes on the results of the voting at the respective station, provided they present a valid accreditation document, and in copy.
  • They cannot intervene in any way in the organization and progress of the elections; they only have the right to notify, in writing, the chairperson of the election bureau in case they notice irregularities.
  • Any act of electoral propaganda, as well as the breach, in any way, of the accreditation act entails application of legal sanctions, suspension of the accreditation by the election bureau that observed the breach, and on voting day, immediate removal of the respective person from the voting station.
  • At the election bureau of the voting station, accredited persons can only stay in the area set aside for this purpose in the voting room, by the chairperson of the election bureau of the voting station.
